Energy Transition and Climate Disputes – Why Now?
The SCC Arbitration Institute, the Chartered Institute of Arbitrators, and CEDR invite you to participate in Energy Transition Forum on 18 April 2023.

2023 will be a watershed year for climate litigation. We are witnessing the co-development of international and domestic climate law with climate science and energy transition economics, which will impact all global economic activity, civil society, and States. The Energy Transition Forum will explore the basis for energy transition disputes, the intersection with ESG, and possible ways to mitigate the impact.
The program starts with opening remarks by Caroline Falconer (General Secretary at SCC), and Wolf von Kumberg (Mediator and Member at Arbitra, and Former Chair Board of Management, Ciarb), followed by keynotes by Dr. Crina Baltag (Professor in Law at Stockholm University), with key takeaways from the review of the Queen Mary Future of International Energy Arbitration Report. Three panel debates will then follow.
Energy Transition Disputes will be the topic for the first panel to discuss, with Wolf von Kumberg as the moderator. Topics will be presented by Kai Uwe-Karl (Global Chief Litigation Counsel at GE Renewable Energy), Tom Melbye Eide (Independent Executive, previously EVP General Counsel at Shell), Tasneem Azad (Managing Director at Kroll), Polina Permyakova (Partner at Delphi) and Jessica Crow (Independent Arbitrator at Arbitra).
The second debate, moderated by James South (Chief Executive at CEDR) will focus on Energy Transition and States. Topics will be given by Mark Appel (Member of ARbDB Chambers), Paul Sills (Member at Arbitra), and Joe Tirado (Partner at Garrigues) and will include discussions on what it means to be Paris compliant and how states will transition to sustainable energy projects.
Finally, the third debate will discuss how ESG fits into the Mix, moderated by Mercy McBrayer (Head of Policy and Arbitration Professional Practice at Ciarb). The panelists are Karl Mackie (Founder President at CEDR), Elise Groulx (International Business and Human Rights Lawyer), Jillian Kirn (Sustainability and Compliance Advisor at Climate Change Counsel), and Maria Fogdestam Agius (Partner at Westerberg & Partners).
