While settlement is frequently referenced as a desirable outcome, less attention is paid to how and when it actually occurs in practice. This session brings together empirical insights and practitioner perspectives to examine the realities behind settlement decisions.
What we will discuss
The session will combine:
Empirical insights from the SCC’s recent report on settlements, including:
- Timing of settlements
- Procedural triggers
- Efficiency considerations
Practical perspectives on:
- The role of the arbitral tribunal in facilitating settlement
- Differences across jurisdictions and procedural cultures
- The extent to which settlement can be actively encouraged versus emerging organically
We will also explore the virtues and limits of commonly cited “settlement tools”, such as:
- Preliminary views
- Bifurcation
- Mediation windows
- and consider whether settlements more often arise from procedural milestones rather than deliberate intervention.
