Notarization and certification of arbitral awards

The enforcement of an arbitral award abroad may, in some cases, require notarization or certification of the arbitral award. The SCC assists parties with the notarization or certification of arbitral awards rendered under the SCC Rules.

The procedure

The parties may request certification or notarization of the original award or a copy of the original award. Should you wish certification or notarization of the original award, the original award must be provided by the applicant.

1. The applicant sends an email to the SCC Secretariat (arbitration@sccarbitrationinstitute.com) with the request for certification or notarization of the arbitral award, including:

An application for notarization must specify the jurisdiction in which the applicant is seeking enforcement of the arbitral award, and whether the applicant seeks notarization of a true copy (i.e. not an original) of the arbitral award.

      2. The SCC Secretariat confirms receipt of the request for certification or notarization of the arbitral award and, should it be needed, request any additional information required to proceed with the certification/notarization.

      3. Once the SCC Secretariat has all the required information, the applicant shall pay the fee to the SCC and provide a receipt of payment.

      4. Should the applicant wish to have the original arbitral award certified/notarized, this should be sent to the SCC at the address provided in the SCC Secretariat’s confirmation letter.

      5. The process typically takes one week from the receipt of the original arbitral award and payment of the fee. The procedure for the SCC to assist with the notarization or certification of an arbitral award is as follows.

      Certification of an arbitral award

The SCC certifies that an arbitral award under the SCC Rules has been rendered and is enforceable.

This service is free of charge for one copy. Should the applicant wish to certify multiple copies of the arbitral award, a fee of EUR 1,000 is charged for the second copy, and thereafter EUR 300 per additional copy.

The document(s) are sent to the applicant by post or can be collected at the SCC office.

      Notarization

Should the applicant wish the award to be notarized by a Notary Public, a fee of EUR 3,000 is charged.

The document(s) are sent to the applicant by courier or can be collected at the SCC office.

For states that have acceded to the Convention Abolishing the Requirement of Legalisation for Foreign Public Documents, The Hague, 5 October 1961 (Apostille Convention), see https://www.hcch.net/en/instruments/conventions/status-table/?cid=41

      Fee

The SCC reserves the right to increase the fee in the event the application entails more extensive work or there are additional costs for notarization or certification of the award. The applicant will be informed of any such increase to the fee before further action is taken.
