SCC Arbitration Institute Hosts Event on Public Procurement Disputes

On 28 March 2025, the SCC Arbitration Institute held an event titled "How Can Arbitration Ensure Quicker Resolution of Public Procurement Disputes?". The event featured speakers who shared their insights on the benefits of arbitration in public procurement contracts.

Olof Larsberger, Partner at Kastell Advokatbyrå, highlighted three key advantages of arbitration: predictability, the selection of specialised arbitrators, and internationally renowned dispute resolution. He explained that establishing a timetable immediately provides predictability, while selecting arbitrators with specific competence ensures the best fit for individual disputes. He also noted that arbitration should be considered in all public procurements due to its efficiency and effectiveness.

Sara Catoni, General Counsel at SKR (Swedish Association of Local Authorities and Regions), emphasised the quality and high level of professionalism inherent in arbitration. She pointed out that arbitration is particularly suitable for high-stake projects, such as construction contracts and those involving international aspects.

The event also saw the discussion of a report by the SCC on Dispute Resolution in Public Procurement Contracts. The report compares disputes involving public procurement contracts at the SCC Arbitration Institute to cases in general courts, concluding that SCC cases involve significantly higher amounts and are resolved in less time, saving over a year’s time.

Moderated by Madeleine Thörn, Deputy Secretary General of the SCC Arbitration Institute, the roundtable discussion delved into the report’s findings and the key benefits of arbitration.

Madeleine Thörn shared that “it is clear from the report that a significant amount of time – and thereby costs – can be saved by choosing arbitration. Confidentiality is in the hands of the parties and therefore, if no confidentiality agreement exists between the parties, the parties are free to share all the information about the arbitration in order to comply with compliance regulations for the public sector.”
