Dispute Resolution with Public Entities
One of the most notable webinars, streamed on 11 November, explored the challenges and opportunities in resolving disputes involving public entities. Featuring SCC Deputy Secretary General Madeleine Thörn and SCC Legal Counsel Lina Krait, the session tackled critical questions, such as:
- Does Sweden’s Public Procurement Act (LOU) hinder arbitration for disputes with public entities?
- How does confidentiality in arbitration align with Sweden’s strict transparency requirements for public records?
- What are the advantages and disadvantages of arbitration compared to litigation in these scenarios?
This webinar attracted legal professionals eager to gain clarity on the practical implications of resolving disputes with public entities.
Arbitration Week 2024: Focus on Public Procurement Disputes
During SCC Arbitration Week, a dedicated session on 21 October examined arbitration in public procurement contracts. Key speakers, including Julia Tavaststjerna (Region Stockholm), Olof Larsberger (Kastell Advokatbyrå), and Madeleine Thörn, shared insights into how arbitration differs when public entities are involved.
This event coincided with the release of the SCC’s groundbreaking report comparing dispute resolution in public procurement cases through arbitration with the courts. Attendees gained valuable insights into the efficiency and practicality of pursuing arbitration or other ADR methods in these contexts.
Costs of Arbitration and Transparency
On 3 October, the SCC hosted a webinar on the costs of arbitration and allocation of costs, presenting updated data and insights from its latest report. Featuring Jake Lowther, Lotta Knapp Lönroth, and Tobias Hamrin, the event highlighted efforts to enhance cost transparency and efficiency under the SCC Rules, including for expedited arbitrations. This session was a must-attend for arbitration practitioners, users, and funders with a focus on obtaining cost-effective dispute resolution.
International Contract Negotiations: Regional Trends in Arbitration
In a standout event streamed on 21 February, the SCC explored regional practices and preferences in arbitration across Denmark, Germany, Norway, Lithuania, and Sweden. The panel included distinguished experts such as Sven Lange (Germany), Ramunas Audzevicius (Lithuania), and Knud Knudsen (Norway). Moderated by SCC Secretary General Caroline Falconer, the discussion offered participants valuable insights into the evolving landscape of dispute resolution in Northern Europe.
