Protracted disputes threaten public procurement contracts – SEK 900 billion at stake every year

The total value of public procurement in Sweden is approximately SEK 900 billion per year. When public procurement disputes arise, large sums of money are at stake. A new report from the SCC Arbitration Institute shows that these disputes can be resolved on average almost a year faster through arbitration than in court. Improving time efficiency is crucial to ensure that critical public investments are not delayed.

Book Launch: Elevating Arbitration Practices in Sweden

A landmark publication in Swedish, "Högkvalitativa skiljeförfaranden i Sverige" (in English: High-Quality Arbitration in Sweden), has been released, marking a significant milestone for Swedish commercial arbitration. New SCC Practice Note on Security for Costs

In 2017, the SCC added user-friendly provisions to the SCC Rules, including on security for costs. After the SCC Rules were revised in January 2023, SCC Legal Counsel Jake Lowther and former Intern Gaurav Majumdar reviewed and summarised the decisions on security for costs in closed proceedings from 2017 to 2022.

SCC 2023 Analytics: “Ad hoc vs. Institutional Arbitration in Construction Disputes”

It is more expensive and time-consuming to resolve construction disputes in ad hoc arbitration than at the SCC Arbitration Institute. This is demonstrated in a new report by SCC Deputy Secretary General Natalia Petrik and Hammarskiöld Associate Adam Runestam. The report compares 35 ad hoc arbitrations with 25 arbitrations under the SCC Rules.

SCC Practice Note: Prima Facie Jurisdiction between 2013–2023

The SCC Arbitration Institute publishes a new practice note focusing on the decisions on prima facie jurisdiction issued by the SCC between 2013 and 2023. In the practice note, the SCC’s stance in relation to its prima facie jurisdiction is discussed, and the cases where the SCC found it manifestly lacked jurisdiction are presented. The practice note is written by Adam Runestam, intern at the SCC during January to March 2023 and associate at Hammarskiöld.
